Terms of Service

These Terms explain the rules for using Evalynq Talent as a job seeker, recruiter, organization, reviewer, or administrator.

1. Agreement and operator

These Terms of Service ("Terms") apply to your access to and use of Evalynq Talent, including its website, accounts, talent marketplace, job listings, applications, assessments, and related services (the "Service"). By creating an account, accepting an invitation, or using the Service, you agree to these Terms. If you use the Service for an organization, you confirm that you are authorized to accept these Terms for it.

The Service is operated under the Evalynq brand. The current contact for legal and service notices is support@evalynq.com. Evalynq has not yet published a registered legal entity name or registered address; this information will be updated when available.

2. Eligibility and accounts

  • You must be legally able to enter into a binding agreement in your location. The Service is intended for working-age job seekers and organization staff, not children.
  • Provide accurate registration and profile information, keep it reasonably current, and protect your sign-in credentials. You are responsible for activity under your account, except where caused by our failure to secure the Service as required by law.
  • Do not create an account using a false identity, impersonate another person, or register for a role you are not authorized to use.
  • Recruiter accounts, organizations, and access to particular features may require email verification, organization verification, an invitation, or an applicable subscription or payment.

3. The Service and user roles

The Service connects job seekers, recruiters, organizations, assessment reviewers, and administrators. Features include professional profiles, CV import, job discovery and applications, skills assessments, human review, assessment results and badges, recruiter search and shortlisting, candidate access requests, consent-based profile access, and organization tools. Feature availability can vary by role, organization status, plan, and location.

Evalynq is a platform provider, not a recruiter, employer, staffing agency, or party to an employment relationship between a candidate and an organization. Organizations are responsible for their job postings, recruitment processes, employment decisions, and compliance with laws that apply to them.

4. Job-seeker accounts and candidate content

  • You retain your rights in information and files you submit. You give us permission to host, process, reproduce, format, and display them as reasonably necessary to operate the Service, provide CV import, administer assessments, and carry out the visibility or application choices you make.
  • You are responsible for having the rights and permissions needed to upload your CV, work samples, images, and other content. Do not upload confidential information belonging to another person or organization unless you are authorized to do so.
  • CV import generates a profile draft from your uploaded CV. You must review the draft and choose what to add to your profile; the system does not guarantee that extracted details are complete or correct.
  • You control whether your eligible profile is visible in the roster. Contact information and original CV access are restricted. A recruiter may receive that information only where the Service’s access rules are met, including any required candidate consent. When you apply to a particular job, you authorize the application information and files you submit to be shared with that recruiting organization.
  • Do not misrepresent your qualifications, assessment results, employment history, availability, or identity. Notify us if information in your account is being used without authorization.

5. Assessments, review, and results

  • Follow the assessment instructions and rules shown for each assessment. Do not obtain or share restricted questions or answers, impersonate another participant, tamper with assessment systems, or interfere with review processes.
  • The Service may save answers as you work, enforce deadlines, score objective questions, and provide submissions to assigned human reviewers. Configured browser integrity signals may be recorded for review. These signals can be incomplete or inaccurate and do not alone establish misconduct.
  • A score, badge, result, or profile does not guarantee employment, an interview, a credential accepted by another organization, or a particular hiring outcome. Organizations make their own decisions and must not treat an assessment result as the sole basis for a consequential employment decision where applicable law requires human review or other safeguards.
  • Assessment questions, rubrics, answer keys, and review materials may be confidential or proprietary. Do not copy, publish, reverse-engineer, distribute, or use them outside the permitted assessment unless the rights holder authorizes it.

6. Recruiter and organization accounts

  • Organizations must provide accurate organization and recruiter information and keep membership, roles, and contact details current. Organization owners and administrators are responsible for managing access for their team.
  • Use candidate data only for legitimate recruitment purposes related to the job, assessment, or access request for which it was made available. Do not scrape the Service, build unauthorized candidate databases, contact candidates outside the consent or access scope, or disclose CVs and personal details to unauthorized people.
  • Organizations must provide appropriate privacy notices, choose a lawful basis, honor data-subject requests, secure candidate information they receive, and comply with applicable employment, anti-discrimination, privacy, and consumer-protection laws.
  • Do not use the Service to discriminate unlawfully, harass or exploit candidates, publish deceptive or unlawful job listings, or make decisions based solely on automated processing where prohibited or where required safeguards have not been met.
  • Organizations are responsible for the content of their jobs, assessments, questions, screening criteria, and integrations, and for obtaining any rights or permissions required to use them.

7. Candidate consent and profile access

The Service may let a recruiter request access to candidate contact details or an original CV. The candidate decides whether to approve or decline a request where the consent flow is presented. Recruiters must respect the decision, scope, duration, and revocation state shown by the Service. A prior consent does not authorize unrelated use or onward disclosure.

8. Plans, fees, and payments

Job seekers may use the candidate features described as free in the Service. Recruiter plans, paid features, billing periods, and any applicable transaction charges are shown to an authorized recruiter in the recruiter dashboard or in the applicable order or checkout details. The price and terms shown at purchase or in a separate written agreement control for that purchase.

Where a payment is enabled, the Service may direct you to Chapa or another configured payment provider. That provider processes payment information under its own terms and privacy notice. Evalynq does not store full payment-card numbers in the Service. You authorize the applicable charge when you complete checkout. Taxes, renewal, cancellation, and refund terms, if any, will be stated in the checkout or separate written agreement; contact support@evalynq.com if they are not clear before purchase.

Do not submit payment information through email or an unapproved form. We may suspend access to paid features for unpaid, reversed, or disputed transactions, subject to applicable law and the applicable purchase terms.

9. Acceptable use

You may not, and may not help another person to:

  • Break the law, violate another person’s rights, or use the Service for fraud, harassment, discrimination, or deceptive recruitment.
  • Access, test, scan, or interfere with accounts, data, systems, or endpoints without authorization; bypass role or consent controls; or exploit a vulnerability.
  • Scrape, crawl, harvest, copy, bulk-export, or republish candidate, job, assessment, or platform content except through an expressly authorized feature or agreement.
  • Upload malware, spam, unlawful content, confidential information without permission, or material that infringes intellectual-property, privacy, or publicity rights.
  • Reverse engineer, decompile, or attempt to extract source code, answer keys, scoring logic, credentials, or other non-public materials, except to the extent such restriction is prohibited by law.
  • Use results, profile information, or integrity signals as the sole basis for an employment decision where applicable law requires meaningful human involvement or other safeguards.

10. Intellectual property and feedback

Evalynq and its licensors own the Service software, branding, design, assessment platform, and other materials we provide, except for user content and third-party materials. These Terms grant you a limited, revocable, non-exclusive right to use the Service for its intended purpose while your account or organization access is active. No other rights are transferred.

If you send suggestions or feedback, you allow us to use them to improve the Service without payment or obligation, provided we do not identify you publicly without permission.

11. Third-party services and integrations

The Service may link to or connect with external websites, payment providers, email and storage providers, applicant-tracking systems, APIs, or webhook endpoints. Those services are operated by third parties and governed by their own terms. We are not responsible for their content or availability. An organization that configures an integration is responsible for its endpoint, security, lawful use, and the data it chooses to transmit.

12. Privacy

Our Privacy Policy explains how personal information is handled and how to make a privacy request. Organizations may have separate responsibilities and notices for recruitment data they control. By using the Service, you acknowledge that data may be processed as described in those applicable notices and agreements.

13. Suspension and termination

You may stop using the Service at any time. Contact support@evalynq.com for account closure or deletion requests. Organization owners may manage team membership in the Service, subject to any applicable agreement.

We may suspend or restrict access where reasonably necessary to protect the Service or another person, respond to suspected fraud or security incidents, enforce these Terms, comply with law, or address non-payment. Where appropriate, we will provide notice and a chance to resolve the issue. We may terminate or discontinue all or part of the Service with reasonable notice where practicable.

On termination, your right to use affected features ends. Provisions that by their nature should continue—including accrued payment obligations, intellectual-property rights, disclaimers, limits of liability, dispute terms, and necessary data retention—will survive to the extent permitted by law.

14. Disclaimers and limitation of liability

To the extent permitted by law, the Service is provided on an “as available” basis. We do not warrant uninterrupted access, error-free operation, or that assessment materials, profile information, CV extraction, or results will be complete, accurate, or suitable for every purpose. Nothing in these Terms limits a right or remedy that cannot lawfully be limited.

To the extent permitted by law, Evalynq is not liable for indirect, incidental, special, consequential, or punitive loss, loss of profits or opportunities, or decisions made by an organization using candidate information or assessment results. To the extent liability cannot be excluded, our aggregate liability for claims relating to the Service is limited to the amount you or your organization paid to Evalynq for the affected Service during the twelve months before the event giving rise to the claim. This limitation does not apply where applicable law prohibits it, including liability that cannot legally be excluded or limited.

You are responsible for your use of the Service and for the decisions you make from information available through it. Organizations remain responsible for their hiring decisions and for their independent assessment of candidates.

15. Changes to the Service or these Terms

We may update features or these Terms as the Service changes or to reflect legal, security, or operational needs. We will revise the effective date and give additional notice of material changes where appropriate. Changes apply from the effective date stated in the updated Terms; continued use after that date means you accept the updated Terms where acceptance by continued use is permitted by law. If you do not agree, stop using the affected Service and contact us about account closure.

16. Governing law and disputes

These Terms are governed by the laws of Kenya, without limiting any mandatory consumer or employment protections that apply in your location. The courts of Kenya will have jurisdiction, subject to any non-waivable right to bring a claim in another competent forum. Before filing a claim, contact support@evalynq.com and give us a reasonable opportunity to resolve the concern. Nothing in this section prevents either party from seeking urgent legal relief where necessary.

17. General terms and contact

If a provision of these Terms is unenforceable, the remaining provisions remain effective to the extent permitted by law. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent, except where applicable law permits it. We may transfer these Terms as part of a merger, reorganization, or transfer of the Service, subject to applicable law. These Terms and any applicable order form or written data-processing agreement form the agreement regarding the Service and replace prior discussions about the same subject.
